FOND DU LAC, WI — A fatal shooting involving a Fond du Lac County Sheriff’s deputy is found to be justified. District Attorney Eric Toney says Deputy Blaine Evans was responding to a threatening situation involving Kyle Massie in the morning of October 14 when Massie fired first.
“There is no basis to consider or issue any criminal charges in the circumstance against Deputy Evans,” Toney said. “Or any other law enforcement officer that assisted. I found that his actions were priviledged in self-defense and that, as I noted no charges are warranted.”
District Attorney Toney also finds that Deputy Blaine Evans was justified in shooting Kyle Massey during that early moring firefight.
“Deputy Evans had attempted the traffic stop with lights, siren and a pit maneuver,” Toney says. “Kyle Massey was refusing to comply with his commands and then exiting with a long-gun. And Deputy Evans was priviledged to use self-defense at that time because his beliefs were reasonable that Kyle Massey was attempting to get into a firing position on Deputy Evans.”
Canine unit “Kiro” was shot several times by Massie–but survived life-threatening injuries. Massie was killed in the exchange of gunfire.
