MADISON, Wis–Convicted murderer will not get a hearing on arguments that another member of his family killed Teresa Halbach. The state Court of Appeals denies Avery’s latest argument that he was framed by someone else living at the family compound in 2005.

The appeals judges found that Avery did not present sufficient facts to satisfy the requirements for third-party perpetrator evidence to be tested.
Avery claims a witness saw another family member pushing Halbach’s S-U-V into a hiding spot in the family’s auto salvage yard, and that investigators and prosecutors did not provide that information to Avery’s defense team in a timely manner.
He continues to serve a life prison sentence.
